Cooperation rules

1.1. The Seller is SIA “PIECAS DIENAS”, registration No. 44103127212, legal address: Siguldas nov., Sigulda, Krišjāņa Barona iela 4 – 24, LV-2150; e-mail address: toskinprofile@gmail.com ; tel. +371 26444554 ; (hereinafter – the Company), on the website of the online store www.skinprofile.lv (hereinafter – the e-store).

1.2. Buyer is a natural or legal person (hereinafter – Buyer) who purchases goods (hereinafter – Product) in the Company's e-store.

1.3. When making a purchase in the e-store, the Buyer is obliged to indicate his/her name, surname/surname, mobile phone number, e-mail address and delivery address. When placing an order, the Buyer confirms that he/she has no legal obstacles to concluding an agreement with the Company for the use of the e-store.

1.4. At the moment when the Buyer purchases a Product in the e-store via the Internet, such mutual agreement is considered a Distance Contract and is subject to the legal provisions regulating Distance Contracts, including, but not limited to, the Consumer Rights Protection Law, Cabinet of Ministers Regulation No. 255 of 20 May 2014 "Regulations on Distance Contracts". A distance contract for the purchase of a Product shall be considered concluded at the time of payment for the Product.

2.1. In order to purchase a Product in the e-store, the Buyer does not need to register.

2.2. Procedure for placing an order for goods:

• The buyer must press the “Add to Cart” button.
• To order the selected Product, click the "Proceed to checkout" button in the lower left corner of the Buyer's shopping cart, which displays information about the contents of the cart.
• The Buyer must enter all necessary information to make a purchase and the Company can ensure delivery of the Product.
  

3.1. Online payment by card. Payment is made during the order process by entering the payment card number. Payment can be made with VISA and MasterCard credit and debit cards.

 4.1. The delivery of the Goods is provided by SIA “OMNIVA”, Reg. No.: 40103527192 Dzirnieku iela 24, Mārupe, LV-2167 (hereinafter – OMNIVA) and SIA “DPD Latvija” Reg. No.: 40003393255 Uriekstes iela 8A, Rīga, LV-1005 (hereinafter – DPD). When making a purchase, the Buyer, before paying for the Goods, indicates which OMNIVA or DPD parcel machine he wants to receive the Goods. After confirming the purchase, the Buyer receives the Goods in the parcel machine within 5 business days, if the Goods are in the Company's warehouse. The Buyer is informed about this by text message at the moment when the Goods are delivered to the OMNIVA or DPD parcel machine specified by the Buyer. Specifying a mobile phone number is necessary to receive a text message. If the Buyer does not collect the Product from the specified parcel machine within 7 days after receiving the text message, the Product will be returned to the Company, and thus the Buyer will not be refunded the delivery fee of 3 EUR, which is included in the price.

4.2. For delivery outside the territory of Latvia in Europe, the Buyer must contact the Company by e-mail info@skinprofile.lv indicating the delivery address outside Latvia. Depending on the recipient, the delivery fee and terms are determined in accordance with the rules of OMNIVA or AS "Latvijas Pasta" for international shipments from Latvia to foreign countries.

5.1. Before placing an order, the Buyer is obliged to familiarize himself with these terms and conditions.

5.2. By placing an order, the Buyer confirms that he/she is fully familiar with these terms and conditions, that these terms and conditions are understandable to the Buyer, that they satisfy the Buyer, that the Buyer agrees to them and that the Buyer will comply with them.

5.3. By concluding a contract with the Company, the Buyer confirms that he/she is familiar with the description and characteristics of the offered Product.

5.4. The Purchase Agreement shall enter into force upon receipt of payment for the order placed by the Buyer by the Company and shall terminate upon delivery of the Goods or upon their complete fulfillment.

5.5. The Buyer purchases, and the Company sells, the Goods ordered by the Buyer, in accordance with the procedures and rules specified in the e-store, based on which a Distance Purchase Agreement is concluded between the Buyer and the Company.

5.6. Each time the Buyer places an order for Goods, the Buyer expresses an offer to conclude the relevant Distance Purchase Agreement for Goods in accordance with the order and these Terms. The Company confirms the conclusion of the relevant Distance Purchase Agreement for Goods or refuses to conclude it. If the Distance Purchase Agreement for Goods between the Buyer and the Company is concluded, a confirmation is sent to the e-mail address specified by the Buyer. Each order for Goods by the Buyer is the basis for a separate Distance Purchase Agreement.

5.7. By concluding a Distance Purchase Agreement for Goods, the Buyer undertakes to pay for the relevant Goods, as well as their delivery.

5.8. The description of the Product and the price in EUR (including all taxes) are indicated on the e-store website and the Buyer has the right to familiarize himself with it before each purchase of the Goods. The Company reserves the right to unilaterally change the price of the Goods at any time. Price changes are not permitted for specific Goods for which a Distance Purchase Agreement has already been concluded between the Buyer and the Company.

6.1. The warranty for the Product offered in the Company's e-store is 2 years.

6.2. If during the warranty period there are any complaints about the quality of the purchased Product, the Buyer may contact the Company with the Product and payment documents. If a manufacturing defect is detected, the Company undertakes to exchange the Product for an identical Product. If a defect is detected that the Buyer himself caused during use of the Product, the product will not be replaced.

6.3. Warranty obligations are canceled in cases where:

• The product has been used for purposes other than its primary function – reading;
• The product has been arbitrarily glued, repaired, modified or otherwise altered;
• The product has been marked, painted, glued, folded, has had notes, cuts or other damage made to it;
• The product has been damaged as a result of natural disasters (fire, flood, storm, etc.);
• The Product has been damaged by foreign objects, insects, liquids or other substances getting inside the Product;
• The product has been damaged upon delivery, which you have not informed the Company about immediately after receipt, but no later than within 14 days.

6.4. In the event that hidden defects (damages) are detected in the ordered Product upon opening the packaging, the Buyer shall return such Product to the Company, where the Product exchange will be carried out. If the Product exchange is not possible, the Buyer shall have the right to refuse the order and receive a full refund of the Product price and the costs associated with the delivery and return of the order.

7.1. The Company undertakes to fulfill the terms of the Distance Contract within the territory of the Republic of Latvia no later than 30 days after receipt of the order from the Buyer or in accordance with the deadlines set by the e-store outside the territory of the Republic of Latvia.

7.2. If the Company cannot fulfill the contract due to a shortage of the Product ordered by the Buyer, the Company shall inform the Buyer thereof. In such case, the Company shall refund 100% of the money to the Buyer.

8.1. In accordance with the Consumer Rights Protection Law, the Buyer has the right to refuse the purchased Product and unilaterally withdraw from the Distance Purchase Agreement within 14 calendar days, and return the Product purchased in the Company's e-shop. The period for exercising the right of withdrawal is counted from the day the Buyer has received the Product. When exercising the right of withdrawal, the Buyer must return the Product at his own expense within 14 days from the day he sent the refusal.

8.2. To exercise the right of withdrawal, the withdrawal notification form must be completed, which the Seller sends to the Buyer by e-mail at the Buyer's request. The Buyer is obliged to return the goods to the Seller within 7 days after sending the withdrawal letter.

8.3. The Company will refund the money for the purchased Product to the account used by the Buyer at the time of purchase within 30 days from the date of receipt of information about withdrawal from the contract together with a document confirming the purchase (printout of the online banking payment order) and the Product will be returned to the Company's address in its complete package or confirmation will be received that the product has been sent back to the e-mail info@skinprofile.lv, depending on which action was taken earlier.

8.4. The Company reserves the right to refuse the Buyer the right of withdrawal or to withhold compensation if the Product is damaged, if the original packaging of the Product is lost or if its packaging is significantly damaged. The Product must not be used and must be in its original packaging.

9.1. The Company transfers information about the Buyer to the Supplier of the Goods OMNIVA, which it needs to process the order. The Company undertakes not to disclose or transfer information about the Buyer to other third parties without the Buyer's written consent, except in cases where the laws and regulations of the Republic of Latvia or this Distance Agreement are violated.

10.1. By entering the required information when placing an order, the Buyer confirms that he has read and agrees that the data provided by him is used so that the Company can accept the Buyer's order and deliver the Goods in accordance with the requirements of the regulatory enactments of the Republic of Latvia. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer's order, and other messages and offers from the Company will be sent to the specified e-mail address.

10.2. The Company has the right to amend and clarify the Terms of Use at any time by publishing the relevant changes in the e-shop. Any changes made to these Terms of Use shall enter into force immediately upon their publication.

11.1. The Agreement enters into force at the moment the Buyer places an order for the Product and remains in force until the Buyer and the Company have fully fulfilled their obligations to each other.

12.1. Disputes arising from the Distance Purchase Agreement or agreements concluded pursuant to it shall be considered by the legal protection institutions of the Republic of Latvia in accordance with the procedure established by the laws of the Republic of Latvia. The legislation of the Republic of Latvia shall apply to the Distance Purchase Agreement and agreements concluded pursuant to it.
